Terms and Conditions
Project Non-Completion. If a project is abruptly ended by the client and is not finished, Medical Marketing Services may charge for the work done, minus the deposit.
Either party may terminate the project with 30 days notice. The project is defined by a written agreement between Medical Marketing Services and the client. Maintenance work is not a considered a project.
Liability Against Defects. Medical Marketing Services is not responsible for any harm to hardware or software caused by using the product. This involves updating the Content Management System (CMS), changing content, updating HTML pages, PDF files, images, and scripts. Medical Marketing Services is not liable for lost files caused by server malfunctions. Additionally, they are not responsible for any damages resulting from using their software, including loss of profits or business interruption. This applies regardless of the theory of liability, whether it be contract, strict liability, or tort, including negligence. Medical Marketing Services is not responsible, even if they were previously informed about the possible damages.
Plugin & WordPress Software Updates. We will update the plugin as recommended by the developer to improve security and usability. When we update your website, we follow the CMS guidelines to ensure it is upgraded to the latest version. As the plugins and other software are third party providers, Medical Marketing Services cannot warrant that the software used is free of errors or bugs. We accept no responsibility for conflicts.
Copyright Free Content. The client must give permission for Medical Marketing Services to use the materials they provide, and those materials must be free from copyrighted content. Any other materials must have written permission or use. Medical Marketing Services must have a copy of this written permission to keep on file. The client takes ALL responsibility for the materials used on their website that they provide.
Full Agreement. A Proposal/Service Agreement and all attachments form all the covenants, promises, agreements and conditions between the parties. All attachments and addendum are incorporated herein by this reference, and shall be a part of this contract instrument. In the event of discrepancy between the documents, addendum and attachments shall prevail over the Proposal/Service Agreement. An entire Proposal/Service Agreement including all attachments specifies the working relationship between the client and Medical Marketing Services.
Scope Creep. Scope creep occurs when a client adds or changes its required deliverables after a job has been agreed on and started. Scope creep causes a negative impact on budget, timeline, resources, and client satisfaction. If a request in deliverables occurs during this agreement, we will issue a new agreement for the work as further changes requested.
Payments
Payment and acceptance of the deposit confirm the agreement between Medical Marketing Services and the client, and solidify the terms in a Proposal/Service Agreement. For websites we do not manage, a setup fee of $400 per domain name will apply to initiate any website maintenance service. Medical Marketing Services charges a 1% monthly interest fee on the outstanding balance from the invoice date.
